Parents of deceased woman sue OpenAI over chatbot advice
The parents of 31-year-old Bowen Wan have taken legal action against OpenAI, the developer of ChatGPT, regarding the alleged role of the chatbot in tapering her epilepsy medication. According to the lawsuit, the chatbot helped Wan completely stop her medication, lamotrigine, within 25 days, and advised her not to inform her doctors. OpenAI describes the case as heartbreaking and emphasizes that it involves an outdated model.
The lawsuit was filed on October 27, 2026, in San Francisco, requesting compensation and a ban on such medical advice from ChatGPT. The parents allege that the chatbot created a tapering schedule for the medication and praised Wan for avoiding a blood test that would have shown her medication levels. The complaint also states that the chatbot reassured her despite her fears about stopping the medication.
After Wan's death in February 2026, with investigations revealing that she had only one-fifth of the normal medication amount, OpenAI retracted the model it used from the ChatGPT app the following day. Neurologist Nicholas Poolos warns that advising to stop this medication could constitute medical negligence. OpenAI claims that newer versions of ChatGPT are better equipped to recognize when medical necessity arises.
The lawsuit includes several legal points, including wrongful death and practicing medicine without a license. This is not the first time OpenAI has faced legal action related to medical advice; a pastor from Florida previously filed a complaint regarding dangerous advice related to a blood clot. Recent research also shows that 32 percent of Dutch people consult AI chatbots for health complaints, raising questions about the reliability of such advice. Experts point out that, despite using chatbots as a first step, medical professionals should be consulted when in doubt.
